The laws of the State of Florida provide for severe penalties on all drug and drug related offenses. Many law enforcement agencies have independent drug units or task forces specifically to investigate these offenses. The criminal penalties related to drug charges have become increasingly severe. These penalties may include:

  • Driver License Suspension - 2 years
  • Vehicle forfeiture
  • Long mandatory Prison sentences
  • Seizure and forfeiture of money, boats, aircraft, real property
  • Revocation of Professional Licenses
  • Revocation of State Licenses
  • Probation or parole
  • Mandatory Drug screening/testing
  • Mandatory Drug counseling
  • Court Fines and costs
  • Employer notification

Because the potential sanctions could have life changing consequences, it is important to consult with a lawyer experienced in representing clients specifically in drug and drug related charges. Each client's case is independently evaluated to determine:

  • Whether there exists sufficient evidence to prove the allegations
  • Was the initial contact with law enforcement legal
  • Whether you or your home/vehicle were legally searched
  • Whether your rights were read to you
  • Did the officer find drugs on your person
  • Whether the drugs were owned by someone else
  • Whether you had a valid prescription

There are many trafficking charges that carry long mandatory prison sentences. The Law Office of Timothy Hessinger, P.A., will evaluate your case and seek a waiver of the minimum mandatory prison sentence from the state attorney. It¿s imperative that this be handled correctly to avoid serious penalties.

At The Law Office of Timothy Hessinger, P.A., my firm requests arrest reports, lab reports, witness statements, etc. from the State Attorney to assist in determining the best course of action in your criminal defense. By doing this prep work, some client cases may result in Pre-Trial Motions being filed in an effort to suppress evidence or dismiss the case.
